This website (the “Site”) is independently owned and operated by David Celaya, a licensed California real estate agent (DRE #01817176) affiliated with Compass. The Site offers information, products, and services related to real estate (the “Services”). In this Privacy Policy and Terms of Use, “we,” “us,” and “our” refer to David Celaya. We may use third-party contractors to support the delivery of the Services and the Site (“Service Providers”).
If you are a visitor to this Site, this Privacy Policy and Terms of Use applies to you and describes the policies and practices regarding the collection, use, and disclosure of your personal information in connection with your use of the Site. We act as the controller of your personal data, and our Service Providers assist us in providing the Services solely in their capacities as service providers and data processors.
This Privacy Policy and Terms of Use does not apply to any websites, applications, or other online services that do not link to this Policy, including other services provided by us or by our Service Providers. If you have questions about our use of your personal information, please contact us using the information in the “How to Contact Us” section below.
Language and Translation
This Site and its content, including this Privacy Policy and Terms of Use, are made available in English and Spanish. The Spanish version is produced in part through automated language conversion and is provided for your convenience only. Automated translation may not fully or accurately convey the meaning of the original text. The English-language version is the original and controlling version; in the event of any conflict, ambiguity, or discrepancy between the English and Spanish versions, the English version governs.

We collect information from you in the following ways when you access or use the Site:
Information You Provide to Us
Contact information you submit through the Site’s contact form or down-payment assistance eligibility form, such as your name, email address, phone number, and any details or questions you include in the message.
Phone and Text Communications
If you call or text the number listed on this Site, or provide your phone number through a form, David may call or text you back at that number to respond to your inquiry or follow up on real estate services you’ve requested. These communications are handled personally by David — we do not use automated dialing systems, autodialers, or bulk SMS/text marketing platforms to contact you. If that changes in the future, we will update this Policy to describe it and provide the required consent and opt-out mechanisms before doing so.
CRM and On-Site Activity Data
When you submit the contact form or the down-payment assistance form, the information you provide is stored in our customer relationship management (“CRM”) system so that we can follow up with you.
For contacts we are already actively working with — for example, someone who has previously reached out and been assigned a tracking identifier — we may associate that person’s on-site activity, such as the pages viewed and time spent on them, with their CRM contact record, so that our follow-up is better informed. We do not do this for anonymous, first-time, or unidentified visitors; there is nothing to associate an anonymous visit with.
Automatic Data Collection
Our Site and hosting provider automatically log standard technical information, such as your IP address, browser type, device type, and general access times, for security and site-operation purposes.
We use a small number of first-party cookies for functionality described above — for example, a cookie that lets us recognize a returning known contact so their on-site activity can be logged to the correct CRM record, and a cookie that lets you opt out of that logging. We do not use third-party advertising cookies, tracking pixels, or web beacons on this Site.
(Note: at the time of this update, this Site does not use Google Analytics or any other third-party analytics service. If that changes, this section will be updated to disclose the specific tool, what it collects, and how you can opt out — before it goes live.)
How We Use Your Personal Information
We use your personal information for the following purposes:
To provide and operate the Site and respond to you: we use the information you submit to respond to your inquiry, answer your questions, and provide the real estate services you’ve requested — including by phone or text, as described above.
To manage our relationship with you: we use our CRM to keep track of our conversations and follow-ups with you, including, for known contacts, the on-site activity described above.
To comply with law: as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process.
For compliance, fraud prevention, and safety: to protect our, your, or others’ rights, privacy, safety, or property, and to investigate and deter fraudulent, harmful, or unlawful activity.
How We Share Your Personal Information
We do not sell your personal information, and we do not share it with third-party advertisers, ad networks, or data brokers. We may share it only with:
Our brokerage: Compass, the brokerage with which David Celaya is affiliated, as required in the ordinary course of a real estate transaction.
Our Service Providers: companies that help us operate the Site and store your information on our behalf, such as our website host and CRM provider, acting solely under our instructions.
Professional advisors: such as lawyers or accountants, where necessary for the services they provide to us.
For compliance, fraud prevention, and safety: for the purposes described above.
Business transfers: in the unlikely event of a sale or transfer of the business, your information may transfer as part of that transaction; we would require the recipient to honor this Policy.
Privacy Choices and Opt-Outs
To opt out of the on-site activity tracking described above, to stop receiving calls or texts from David, or to request that we delete or stop using your information, contact us using the information in the “How to Contact Us” section below and we will honor your request.
Cookies
You can block or delete cookies through your browser settings at any time. Because we only use cookies for the first-party functionality described above (not third-party advertising), blocking cookies will simply prevent known-contact activity logging — it will not remove any ads, since this Site does not serve or personalize ads based on your browsing.
Do Not Track and Global Privacy Control
Some browsers send “Do Not Track” or “Global Privacy Control” (GPC) signals. These signals are designed to opt a visitor out of having their data sold or shared with third parties for cross-context behavioral advertising. Because this Site does not sell personal information, does not share it for cross-context behavioral advertising, and does not use any third-party advertising or tracking technology, there is no such sharing for these signals to opt you out of — so we do not process them as a separate control. If you’d like us to stop the first-party CRM activity logging described above, the reliable way to do that is to contact us directly, and we will honor it immediately.
Privacy Rights
You have the right to request that we disclose the categories of personal information we have collected about you, access a copy of that information, correct information that is inaccurate, or delete information we no longer need. You may also object to or ask us to restrict our use of your information.

Data Retention
We retain personal information for as long as necessary to respond to you, maintain our CRM records for the duration of our relationship with you, and comply with legal or recordkeeping requirements. When it is no longer needed for these purposes, we delete it or retain it only in de-identified form.
Third Party Services
The Site and Services may contain links to websites and other online services operated by third parties, including our IDX home-search portal at search.socal-realestate.com, which maintains its own separate privacy policy. These links are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites or online services operated by third parties, and we are not responsible for their actions or privacy practices.
Security
We use reasonable technical and organizational measures designed to protect the personal information we collect, both during transmission and in storage. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
Children
Our Services are not intended for use by children under 18 years of age. If we learn that we have collected personal information through the Services from a child under 18 without the consent of the child’s parent or guardian as required by law, we will delete it.

Changes to this Privacy Policy and Terms of Use
We reserve the right to modify this Privacy Policy and Terms of Use at any time. If we make material changes, we will notify you by updating the date of this Policy and posting it on this website.
Notice of Collection and Additional Rights for California Residents
If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA”) gives you the rights described below with respect to personal information we may have collected about you.
Categories of Personal Information Collected
In the preceding 12 months, we have collected the following categories of personal information from Site visitors: identifiers (such as name, email address, and phone number, when you submit a form or contact us by phone or text); commercial information (such as your stated property preferences); internet or electronic network activity (such as pages viewed and time spent on them, for known contacts only, as described above); and geolocation data (such as general city or state derived from IP address).
Requests to Know
You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, and the purposes for collecting it. You may submit a request to know using the contact information in the “How to Contact Us” section. We are not required to respond to requests to know more than twice in a 12-month period.
Requests to Delete or Correct
You have the right to request that we delete personal information we have collected about you, or correct personal information that is inaccurate. Upon receiving a verified request, we will do so unless we are otherwise required or permitted by law to retain it.
Authorized Agents
You may designate an authorized agent to make a request on your behalf. We may require the agent to provide proof of your written permission and require you to verify your own identity directly with us.
Methods for Submitting Consumer Requests and Our Response to Requests
You may submit a request to know, delete, or correct via email at david@socal-realestate.com or at the mailing address provided in the “How to Contact Us” section. We will acknowledge receipt within ten (10) business days and respond within 45 calendar days (extendable by an additional 45 days when reasonably necessary, with notice to you). Any disclosure will cover only the 12-month period preceding your request. We do not charge a fee to process a request unless it is excessive, repetitive, or manifestly unfounded.
The Right to Non-Discrimination
You have the right not to be discriminated against for exercising any of your California privacy rights described above.
Selling and Sharing of Personal Data
We do not “sell” personal information, and we do not “share” personal information for “cross-context behavioral advertising,” as those terms are defined under the CCPA. Because there is no such sale or sharing taking place, there is nothing to opt out of under this section — and this is also why we do not treat Global Privacy Control or “Do Not Track” signals as a separate opt-out mechanism (see “Do Not Track and Global Privacy Control” above). If you’d like to stop the first-party CRM activity logging described in this Policy, contact us directly and we will honor it.
Sensitive Personal Data
We do not request or require sensitive personal information (as defined under the CCPA) in connection with your use of the Site.
